The UK Government has announced plans for a nationwide licensing scheme that would make it illegal for shops to sell vapes, tobacco, or nicotine products without official approval — a move designed to “root out rogue traders” and curb youth access.

While the goal is to protect children and ensure responsible retailing, the vaping industry is watching closely — with many warning that tighter rules could backfire if adult smokers lose access to legitimate, safer alternatives.


Licensing: Closing the Gap in Vape Retail Law

At present, any business can sell vapes — no special permit required. That legal loophole has allowed a small number of irresponsible sellers to push cheap, brightly coloured devices next to sweets and toys, often without proper age checks.

The government’s new proposal would change that by requiring a formal retail licence to sell:

  • Vapes and e-liquids
  • Tobacco products
  • Nicotine pouches and related devices

Health Minister Stephen Kinnock said the move would “close a major gap in the law” and give enforcement teams the power to shut down rogue operators for good.

Retailers caught breaking the rules could face unlimited fines or on-the-spot penalties up to £2,500.

“Our new proposals will better protect children by rooting out the rogue retailers blighting our high streets and help adults know which shops are selling legitimate products.”

What the Government Wants Evidence On

The call for evidence goes beyond licensing — it seeks expert opinions from retailers, manufacturers, health professionals, academics and the public on several key areas:

Flavours and Ingredients

  • Which substances should be allowed in e-liquids and nicotine products?
  • How can risks from emissions be reduced?
  • Where have flavour controls worked — or failed — elsewhere?

Nicotine Strength

  • How can we ensure products don’t deliver dangerously high doses?
  • What’s the right balance between safety and effectiveness for smokers looking to quit?

Design and Appearance

  • Should there be restrictions on size, shape or features like digital screens?
  • Should devices resembling stationery or toys be banned?

Industry Compliance and Product Registration

  • Proposes a national product registration system for every vape and nicotine product sold in the UK.
  • Aims to stop unsafe or misleading products reaching the market and build consumer confidence.

The feedback will inform the secondary legislation that supports the Tobacco and Vapes Bill — a landmark law designed to create a smoke-free generation by banning tobacco sales to anyone born after 1 January 2009.


Public Health Reactions

Action on Smoking and Health (ASH) has welcomed the proposals, calling the Bill “a world-leading piece of legislation with the potential to dramatically change how tobacco and vapes are sold.”

ASH Chief Executive Hazel Cheeseman stressed the importance of grounding any regulation in real evidence:

“Ensuring the regulations are shaped by the best available evidence is vital to ensure the bill has its intended impact.” — Hazel Cheeseman, ASH

ASH also pointed to research from King’s College London and University College London showing that branded vape packaging increases youth appeal — 53% of 11–18-year-olds were interested in trying branded vapes versus 38% for plain packaging — but adult interest remained unchanged.

That data could influence how packaging rules evolve, although it reignites the ongoing debate over whether plain packaging helps or simply confuses adult smokers seeking trusted products.


Retailers and Industry: Fair Crackdown or Overreach?

For legitimate vape retailers, the idea of licensing isn’t entirely new — many have long called for stronger enforcement against illegal sellers who flood the market with counterfeit and untested products.

A licensing scheme could finally level the playing field.

However, there are clear concerns:

  • Licensing fees and red tape could hurt small independent vape shops already struggling post-pandemic.
  • Unclear rules on flavour restrictions might disrupt businesses that help adult smokers quit.
  • Heavy-handed enforcement risks pushing consumers towards the black market — where products are completely unregulated.

If the scheme is well-designed, it could strike the right balance — protecting children without punishing responsible traders.

But if it becomes overly bureaucratic or politically driven, it could threaten one of the UK’s most successful harm reduction tools.


Why This Matters for Vapers and Ex-Smokers

Vaping remains the UK’s most effective quit aid. Public Health England’s research repeatedly shows it’s at least 95% less harmful than smoking and doubles the chances of quitting successfully compared to nicotine replacement therapy.

So any change to access, flavours or retail structure directly affects millions of adult vapers who no longer smoke — and the smokers still trying to switch.

The key question now is whether this “licensing crackdown” will strengthen trust in legitimate vaping, or make it harder for smokers to access products that save lives.

The announcement, published on GOV.UK on 23 March 2025, outlines plans to fund an estimated 80 new apprentice enforcement officers over the next year.

What the Crackdown Will Target

Trading Standards teams across England and Wales have already seized:

  • Over 1 million illegal vapes
  • 19 million counterfeit cigarettes
  • 5,000+ kg of illicit hand-rolling tobacco

With extra resources and manpower, local officers will work with police and other agencies to track organised crime groups and remove unsafe products from shops and online sellers.

Why It Matters for Vapers and Retailers

This new funding sits alongside broader measures in the Tobacco and Vapes Bill, including:

  • A ban on tobacco sales for anyone born on or after 1 January 2009
  • New restrictions on vape packaging and flavours
  • A proposed licensing system for vape retailers
  • £200 on-the-spot fines for underage sales

While some of these changes raise concerns among adult vapers, the crackdown on **illicit sellers** is welcomed by many in the legal vape trade — who have long complained of being undercut by unregulated, often dangerous imports.

We fully support enforcement focused on **illegal and non-compliant sellers**. For too long, rogue traders have sold potentially dangerous vapes and given the industry a bad name.

The fact of the matter is that when restrictions and regulations for vapes were first introduced the powers that be should have foreseen the black market trade and provided funding at the time.

While it is better late than never it’s always difficult to get the bull back in it’s pen once it has bolted. The other concern is how much of that budget will be allocated toward illicit vapes?

Last but not least, while £10 million sounds like a lot of money how far will this actually stretch? Will it actually make a difference? I hope so but I have serious doubts.

Considering the lost tax revenue (just for vape products), could, conservatively,  be 3-4 times the funding this looks to be woefully underfunded.

We’ll continue to track how this new enforcement effort is implemented on the ground — and whether it really protects both public health and adult smokers trying to quit.

Responsible actors in the vaping industry have long supported action against illegal sales to children, rightly so.

The UK Vaping Industry Association (UKVIA) and IBVTA have both called for stronger enforcement — but with consistency and fairness.

The biggest difference that could be made is by cracking down on illegal imports from China. Even today there are online stores based in the UK stocking and selling illegal vapes.

These are mainly devices over the 2ml capacity that include nicotine. They are not hiding the fact they do this either.

While I don’t personally agree with even those restrictions the laws are in place and must be followed.

Once the disposable ban comes into place, along with the possible restriction on flavours the black market sellers will be rubbing their hands together. Pay day time for them whilst law abiding vapers get screwed over.

Imagine flat out taking away the very thing that is keeping them off tobacco.

Vaping Still Matters for Harm Reduction

While preventing underage access is crucial, public health organisations including Public Health England and the NHS continue to endorse vaping as a key harm reduction tool for adult smokers.

  • Enforcement must not deter smokers from switching
  • Reputable vape shops play a critical role in cessation support
  • Resources should also target illicit and unregulated sellers

A leading Manchester chest physician and lung cancer specialist has broken ranks with the recent alarmist media narrative around vaping — warning that early, unverified claims about harm could stop smokers from switching to a much safer alternative.

Speaking to the Manchester Evening News, Dr. Matt Evison, clinical lead for Greater Manchester’s Make Smoking History programme, pushed back against the way early findings from a local university vape study are being presented.

His message is clear: vaping is not as harmful as smoking, and telling people otherwise could be deadly.

The Study That Sparked It

In February, Manchester Metropolitan University researcher Dr. Maxime Boidin made headlines when he described preliminary results from a vaping study — the world’s first controlled long-term research of its kind — by saying vaping could be “just as harmful” as smoking.vaping man

The results haven’t been peer reviewed or published. But the headlines went viral.

And that’s exactly what Dr. Evison is worried about.

“From a Tobacco Control Perspective, Vaping Is a Positive Thing”

Dr. Evison didn’t mince words:

“From a tobacco control perspective, vaping is a positive thing. It is a treatment for tobacco dependency, and it’s an effective way of helping someone to become smoke-free and reduce their levels of harm and risk, and from that early death and illness that tobacco inevitably delivers.”

He went on to stress that the public health benefit is enormous — and that over three million people have quit smoking using a vape in the last five years:

“In the last five years about three million people have stopped smoking with a nicotine vape, knowing two out of three of those would have died because of their smoking, so that public health benefit is substantial.

“It Might Prevent Someone from Switching”

Dr. Evison made it clear that comparing vaping to smoking in the media — especially before data is peer-reviewed — is misleading and dangerous.

“If we send out the message to the public that vaping is as dangerous or worse as smoking, which is not true based on medical evidence, then that risks the public thinking that is true and it might prevent someone from switching from tobacco to vaping.”

And that switch, for a smoker, could literally be the difference between life and death.

A Sensible Split: Adult Smokers vs. Youth Vaping

While defending vaping as a powerful cessation tool for adults, Dr. Evison also acknowledged the separate issue of youth uptake — calling for balanced thinking and regulation.

“The concern, and what makes this path very difficult to navigate, is then an entirely separate issue which is about youth vaping…

That is about the risk of somebody who doesn’t smoke taking up vaping, so instead of going from substantial harm risk reduction to a fraction of that, you’re going from no harm to whatever that harm is to an individual of using vaping.”

His solution? Support the Tobacco and Vapes Bill to restrict access and marketing to children, while protecting adult access to a life-saving alternative.

Dr. Evison’s comments are a rare voice of clarity in a storm of vape panic headlines. He’s not defending the vape industry — he’s defending public health.

By separating the issue of adult smokers from youth prevention, and insisting that science, not sensation, should lead the way, he’s helping ensure that vaping stays on the table as the UK’s most effective quit tool.
